국문초록
외국인이 한국법원에서 한국정부를 상대로 제기하는 국가배상소송에는 다양한 저촉법적 쟁점이 있다. 대상판결 사안에서 제기될 수 있었던 다양한 저촉법적 쟁점에 대한 필자의 견해를 정리하면 다음과 같다. 1969년 한월 약정서 제14조는 베트남인 개인의 한국정부에 대한 청구권이 존속함을 확인하고 있었다. 베트남전쟁 당시 주월한국군과 그 소속원은 조약과 기관간 약정에 따라 외교면제를 향유하고 있었고, 1966년 한미 보충약정서가 주월한국군의 전투행위와 비전투행위에 대하여 특수한 해결절차를 규정하고 있었지만, 이들 때문에 베트남인의 한국법원에서의 국가배상소송이 각하되어야 하는 것은 아니다. 한편 대상판결 사안과 같이 피해자가 외국인이고 불법행위지가 외국에 있는 국가배상소송에 우리 국가배상법이 적용되는 이유는 통상의 준거법 결정규칙에 따라 불법행위의 준거법으로 지정된 한국법에 국가배상법이 포함되어 있기 때문이 아니라, 피고가 한국정부인 이상 피해자가 외국인이고 불법행위지가 외국에 있더라도 우리 국가배상법이 일면적으로 직접적용되기 때문이다. 다른 한편 대상판결 사안에 우리 국가배상법이 직접적용되더라도 동법 제2조 제1항 본문의 위법성 요건 등 제한적 범위에서 통상의 준거법 결정규칙을 적용하여 불법행위의 준거법을 판단하여야 하지만, 대상판결의 설시에는 국제사법 이론상 여러 문제가 있다. 2022년 국제사법 부칙과 2001년 국제사법 부칙을 연쇄적으로 적용하면 대상판결 사안에는 구 섭외사법이 적용되었어야 하고(국제사법상 시제법 문제), 이에 따라 법정지법인 한국법이 누적적용되었어야 하는데(구 섭외사법 제13조 제2항, 제3항), 이것이 통상의 준거법 결정규칙에 따르더라도 우리 국가배상법이 적용될 수 있었던 이유이다. 격지불법행위가 아닌 사안에서 국제사법의 명문규정에 반하여 피해자의 불법행위지법 적용 포기는 허용될 수 없다. 피고가 소멸시효 완성 여부라는 쟁점에 대하여 한국법에 근거한 주장을 하였음에도 불구하고 원고와 피고가 불법행위 전체 쟁점에 대하여 한국법으로 사후적 준거법 합의를 하였다고 인정할 수는 없다. 사후적 준거법 합의를 인정한다면 이는 일반예외조항을 구체화한 종속적 연결원칙에 우선하는 것이기 때문에 일반예외조항을 동시에 원용할 수는 없다. 또 다른 한편 우리 국가배상법 제7조의 상호보증요건을 구비하지 못한 경우 그것을 법률요건으로 보아 청구를 기각하는 것도 얼마든지 가능하다. 국가배상법 제8조 본문에 따라 우리 민법을 적용한다면 민법의 시제법 규정에 따라 구법이 적용되어 원고의 국가배상청구권이 이미 소멸시효가 완성되었다고 볼 여지가 있는데, 베트남전쟁 이후 1990년대 들어서 비로소 정립된 소멸시효 남용의 법리를 적용하자면 시제법상 공서를 원용할 필요가 있었다(실질법상 시제법 문제).

In a lawsuit for damages claim filed by foreigners against the Korean government in Korean courts, there are various conflict-of-laws issues to consider. This article analyzes these issues in relation to a specific ruling by the Seoul Central District Court on February 7, 2023 (Docket No. 2020Gadan5110659). Firstly, Article 14 of the 1969 Korea-Vietnam Agreement confirms the right of Vietnamese individuals to file a claim against the Korean government. The fact that ROK Forces in Vietnam enjoyed diplomatic immunity during the Vietnam War and had specific compensation procedures for their activities does not automatically dismiss a Vietnamese individual’s lawsuit in Korean courts. Secondly, if the defendant is the Korean government, Korea’s State Compensation Act (“KSCA”) is directly applicable to the case, even if the victim is a foreigner and the tortious act occurred in a foreign country. However, within the limited scope, such as the illegality requirement in Article 2(1) of the KSCA, the choice-of-law rules for torts should be properly applied, taking into account intertemporal law as well. Thirdly, applying the transitional provisions in Korea’s Private International Law of 2022 and 2001 successively, the case should have been governed by Korea’s Extra-National Private Law (“KENL”) of 1962. According to Article 13(2) and (3) of the KENL, Korean law as lex fori should have been cumulatively applied, potentially leading to the application of the KSCA. Fourthly, in this case, since it does not involve distance torts, the victim cannot waive the application of lex loci delicti commissi. Moreover, the mutual agreement between the plaintiff and the defendant on the applicable law for the entire tort issues as Korean law cannot be recognized solely based on the defendant’s argument regarding the statute of limitations under Korean law. Fifthly, the reciprocity requirement in Article 7 of the KSCA should be considered as a substantive law requirement rather than a procedural law requirement, which could lead to the rejection of the claim rather than the dismissal of the lawsuit. Lastly, if Korea’s Civil Code (“KCC”) is applied according to Article 8 of the KSCA, considering the intertemporal law provisions in the KCC, it could be argued that the plaintiff’s claim has already become time-barred. If the Court intended to apply the abusive principle of the statute of limitations, established only in the 1990s, it would be necessary to consider the principle of intertemporal public policy.
